1. Acceptance and Scope

These Website Terms of Use ("Terms") govern your access to and use of danny5050.com and its public features. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

The Privacy Policy explains how information is handled. The Voice Memo Submission Agreement contains additional terms that apply when you submit a voice memo. If that agreement conflicts with these Terms about a submitted memo, the Voice Memo Submission Agreement controls.

2. The Website

DANNY5050 is a personal creative website presenting video-collage work, an optional private voice-memo submission service, a future Moodblog, support information, and contact information. Features may change, pause, or become unavailable. The website does not promise that a voice memo will be accepted, listened to, used, published, credited, preserved, or answered.

3. Acceptable Use

You may use the public website only for lawful, personal purposes. You may not:

• interfere with, disrupt, damage, or place an unreasonable burden on the website or its providers;
• bypass or attempt to bypass capacity, authentication, access, rate, abuse-prevention, or security controls;
• probe, scan, test, scrape, or access nonpublic systems or information without written authorization;
• introduce malware, harmful code, forged requests, or automated abusive traffic;
• impersonate another person or misrepresent your affiliation or authority;
• submit content you do not have the right to share; or
• use the website in a manner that violates law or another person's rights.

4. DANNY5050 Content

Except for visitor submissions and identified third-party material, the website, its design, video collages, edited media, text, graphics, logos, and other DANNY5050 creative work are owned by or licensed to DANNY5050 and protected by applicable intellectual-property laws.

DANNY5050 grants you a limited, revocable, nonexclusive, nontransferable right to view and use the public website for lawful personal purposes. This right does not authorize you to copy, republish, sell, redistribute, scrape, create a competing archive from, or commercially exploit the website or its creative work except as applicable law permits or DANNY5050 authorizes in writing.

5. Third-Party Services

The website links to services such as YouTube and social platforms that DANNY5050 does not control. A link does not imply endorsement, responsibility, or control. Third-party services apply their own terms, privacy practices, availability rules, and technical requirements.

6. Voice Memos

You must be at least 18 years old to submit a voice memo. The Voice Memo Submission Agreement governs ownership, permissions, editorial use, prohibited submissions, retention, deletion, and the absence of any promise of use, payment, credit, or response. Pressing a send control does not establish acceptance; the service confirms acceptance only after the server has durably stored and accepted the memo.

7. Support Payments Are Not Available

The website does not currently accept one-time or recurring support payments. A Support page, preview, description, or future plan is not an offer, checkout, or promise that a payment feature will open. No payment obligation is created unless a future version presents an active payment flow and its applicable price, cadence, renewal, cancellation, refund, provider, and privacy terms before payment.

8. Availability and Changes

The website and its features are provided on an as available basis. DANNY5050 may pause voice intake because of capacity, security, validation, backup, maintenance, or operational conditions and may modify, suspend, or discontinue a feature. DANNY5050 does not promise uninterrupted, error-free, permanent, or universally compatible operation.

9. Disclaimers

To the maximum extent permitted by law, the website and its content are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or preservation. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

10. Limitation of Liability

To the maximum extent permitted by law, DANNY5050 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, or goodwill arising from or relating to the website.

To the maximum extent permitted by law, DANNY5050's total liability arising from the public website will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid directly to DANNY5050 for the specific service giving rise to the claim during the twelve months before the event giving rise to liability. This limitation does not apply where applicable law prohibits it.

11. Responsibility for Submissions

You are responsible for content you submit and for the promises you make about your authority to submit it. If your knowing or reckless breach of the Voice Memo Submission Agreement causes a third-party claim against DANNY5050, you agree, to the extent permitted by law, to reimburse reasonable losses and costs caused by that breach. DANNY5050 will provide reasonable notice and will not settle a claim in a manner that admits wrongdoing by you without your consent.

12. Governing Law and Disputes

These Terms are governed by the laws of Illinois, without regard to conflict-of-law principles, except where mandatory law provides otherwise. A court proceeding that may lawfully be limited to a location must be brought in a state or federal court located in Cook County, Illinois.

Before filing a claim, you and DANNY5050 agree to make a good-faith effort for 30 days to resolve the matter by email. Either party may seek urgent relief when reasonably necessary to protect safety, privacy, security, or intellectual-property rights.

13. General Terms

If any provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a provision is not a waiver. You may not assign your rights under these Terms without written permission. DANNY5050 may assign these Terms as part of a lawful transfer of the website, subject to the Privacy Policy. These Terms, the Privacy Policy, and any applicable Voice Memo Submission Agreement constitute the complete agreement concerning the public website and a submitted memo.

14. Changes to These Terms

DANNY5050 may update these Terms prospectively. The current version and Effective Date will appear at the top of this page. A change will not retroactively expand the license granted for a voice memo submitted under an earlier agreement version.
